President Dr. Arif Alvi has reversed a Wafaqi Mohtasib decision directing the Employees Old-Age Benefits Institution (EOBI) to pay pension arrears after her husband’s death in 2017.
The directive was issued in response to a complaint filed by the complainant, Ayesha Arif, widow of Arif Mehmood, who challenged the order of Wafaqi Mohtaisb dated 25-11-2020, which upheld EOBI’s decision of granting pension and paying six months’ arrears under survivor’s pension against her claim filed on 06-08-2019.
The compliance of the same matter shall be made within thirty days after receipt of the stated order, according to a directive from the President’s Secretariat (Public). On July 14, the matter was presented in court. In order, the president pointed out that Section 22B of the Act of 1976 dealt with survivors’ pensions, under which the surviving spouse became liable for a pension. “It is no way hinders or restricts the right as Section 22 (3) of the Act does.” “Section 22B functions independently since it only deals with survivors’ pension,” according to the ruling.
